1. Agreement to Terms

By accessing or using BehindVideo ("the Service"), operated by Mobilefunk, a company registered in the Netherlands, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BehindVideo is a browser-based video editing platform that provides AI-powered background removal, multi-layer editing, text and effect overlays, and video export capabilities. The Service is available in free and paid tiers.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 16 years old to create an account.

4. Free and Paid Plans

The Service offers a free tier with limited features and paid subscription plans with additional capabilities. Plan details, pricing, and feature limits are described on our pricing page.

• Free accounts may be subject to project limits, resolution caps, and watermarks on exported videos.
• Paid subscriptions are billed on a recurring basis (monthly or yearly) through Stripe.
• You may cancel your subscription at any time. Access continues until the end of your current billing period.
• Refunds are handled on a case-by-case basis. Contact us at info@mobilefunk.nl for refund requests.

5. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, abusive, or infringes on third-party rights.
• Use the Service to generate or distribute deepfakes, non-consensual intimate imagery, or misleading content intended to deceive.
• Attempt to reverse-engineer, exploit, or overload the Service.
• Share your account credentials or allow unauthorized access.
• Use automated tools (bots, scrapers) to access the Service without permission.

We reserve the right to suspend or terminate accounts that violate these terms without notice.

6. Intellectual Property

Your content: You retain all rights to the videos, images, and other content you upload and create using BehindVideo. We do not claim ownership of your content.

Our service: The BehindVideo platform, including its design, code, AI models, and branding, is owned by Mobilefunk and protected by intellectual property laws. You may not copy, modify, or redistribute any part of the Service.

7. AI-Generated Content

The Service uses artificial intelligence for features such as background removal, video generation, and content suggestions. AI output may not always be accurate or suitable for your purposes. You are responsible for reviewing and using AI-generated content appropriately.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR).

9. Availability and Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We are not liable for any data loss — please keep local backups of important projects.

10. Limitation of Liability

To the maximum extent permitted by Dutch law, Mobilefunk shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent courts in the Netherlands.
